Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Suitone mobile application, website, and related services (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

1. Eligibility and Account Setup

• You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use Suitone. By using the Services, you represent that you meet this requirement.
• Suitone currently relies on anonymous authentication through Supabase. A unique identifier is automatically assigned to your device. Do not share your device or access credentials with others; you are responsible for all activity under your account.
• You may not use the Services if doing so would violate applicable laws or regulations, including any export control or embargo laws.

2. Our Services

• Suitone provides AI-assisted skincare analyses, lifestyle tracking tools, educational content, and personalized recommendations based on self-supplied information.
• Analyses are generated by artificial intelligence and statistical models that rely on the quality of data you provide (e.g., selfies, lifestyle entries). Results may vary from analysis to analysis.
• The Services are intended for informational and wellness purposes only. Suitone does not provide medical or dermatological diagnoses, and the Services are not a substitute for professional medical advice. Always consult a qualified healthcare professional about skin or health concerns.

3. User Responsibilities

When using Suitone you agree to:

• Provide accurate, lawful, and non-infringing information.
• Obtain permission from any individual whose image or data you submit; the Services are designed for selfies of yourself only.
• Maintain appropriate device security (screen lock, OS updates) and notify us immediately via info@suitone.app if you suspect unauthorized access or a privacy issue.
• Use the Services only for personal, non-commercial purposes unless you obtain prior written consent from Suitone.
• Comply with all applicable laws and these Terms.

You agree not to:

• Upload content that is illegal, obscene, harassing, defamatory, discriminatory, or otherwise objectionable.
• Attempt to collect, reverse engineer, decompile, or gain unauthorized access to any part of the Services or the Supabase, OpenAI, Mixpanel, RevenueCat, or Expo platforms we rely on.
• Interfere with or disrupt the Services, including by transmitting malware or using automated scripts.
• Use the Services to provide medical advice, or to process data of third parties without their explicit consent.

Suitone reserves the right to suspend or terminate any account that violates these obligations.

4. User Content and License

• You retain ownership of the selfies, lifestyle entries, notes, and other information ("User Content") you submit to Suitone.
• By submitting User Content, you grant Suitone a worldwide, royalty-free, non-exclusive, transferable license to host, store, process, analyze, transmit, and display that content solely to operate, improve, and provide the Services to you and other users.
• You affirm that you have all necessary rights to grant this license for any content you upload. You must not upload content that infringes third-party rights.
• You may delete your User Content at any time through in-app controls (Settings → Delete All Data). Deletion requests may take up to 30 days to propagate across backup systems and third-party processors.

5. Subscriptions, Purchases, and Trials

• Premium features and increased analysis limits may be offered via auto-renewing subscriptions processed through Apple App Store or Google Play billing, with RevenueCat managing entitlements.
• Prices, billing cycles, and renewal terms will be displayed at the point of purchase. Taxes may apply based on your location.
• Payments, cancellations, and refunds are handled by the platform (Apple or Google). Review their policies for details on cancellation deadlines and refund eligibility. Suitone does not provide direct refunds unless legally required.
• If a payment fails or a subscription expires, premium access may be suspended until billing issues are resolved.
• Introductory offers, trials, and discounts are subject to change. Suitone may modify or discontinue subscription offerings with reasonable notice.

6. Third-Party Services

Suitone integrates with several processors to deliver core functionality:

• Supabase for authentication, databases, file storage, and Edge Functions.
• OpenAI for AI-driven skin analyses, fusion insights, and recommendation generation.
• Mixpanel for product analytics (EU endpoint).
• RevenueCat for subscription entitlement management.
• Expo and push notification providers (APNs, FCM) for device notifications.

These providers may process your data in jurisdictions outside your own. Their use is detailed in our Privacy Policy. Your continued use of Suitone signifies agreement with such third-party processing.

7. Privacy

Our Privacy Policy explains what data we collect, how it is used, and how you can exercise your rights. By using Suitone, you acknowledge that your personal data will be handled in accordance with that policy.

8. Intellectual Property

• Suitone, its logos, interface designs, text, graphics, and other proprietary materials are owned by Suitone or its licensors and are protected by intellectual property laws.
• You may not copy, modify, distribute, sell, or lease any part of the Services without our written permission.
• Feedback or suggestions you provide may be used by Suitone without obligation to you.

9. Disclaimers

• The Services and all content are provided on an "as-is" and "as-available" basis. Suitone disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.
• AI analyses, fusion insights, and recommendations are informational. Suitone does not guarantee their accuracy, completeness, or usefulness, and does not accept responsibility for decisions you make based on them.
• Suitone does not warrant that the Services will be uninterrupted, secure, or error-free, or that defects will be corrected.

10. Limitation of Liability

To the maximum extent permitted by law, Suitone, its affiliates, officers, employees, agents, suppliers, or licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

1. Your access to or use of (or inability to access or use) the Services;
2. Any conduct or content of any third party;
3. Unauthorized access, use, or alteration of your transmissions or content;
4. Reliance on AI analyses or recommendations.

In all cases, Suitone's aggregate liability shall not exceed the amount you paid (if any) in the 12 months preceding the event giving rise to the claim. Certain jurisdictions do not allow limitations of liability; in those cases, these limitations shall apply only to the extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Suitone and its affiliates, officers, directors, employees, consultants, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms or applicable law.

12. Suspension and Termination

Suitone may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, misused the Services, or pose a risk to others. Upon termination:

• All licenses and rights granted to you in these Terms will cease immediately.
• You must stop using the Services and delete any copies of Suitone materials.
• Sections of these Terms that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability, indemnity, governing law) will remain in force.

You may cease using the Services at any time. You can delete your data in-app or by contacting us.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Türkiye, without regard to conflict-of-law principles. Any disputes arising out of or relating to the Services or these Terms shall be resolved in the courts located in Istanbul, Türkiye, unless applicable law requires a different venue. Mandatory consumer protection rules in your country of residence continue to apply.

14. Changes to the Services and Terms

• Suitone may modify, suspend, or discontinue any part of the Services at any time, including features, content, or availability.
• We may revise these Terms from time to time. When we do, we will update the "Last updated" date and, if the changes are material, provide additional notice (e.g., in-app banner). Your continued use of the Services after the effective date of revised Terms constitutes acceptance. If you do not agree, you must stop using the Services.
